O-1B Visa Immigration Legal Services
Be more flexible. Have less time pressure. Don’t be controlled by one employer. The O-1B is a fast-track for artists and creative professionals at the top of their field.
91.2%
of O-1 petitions approved through Q2 of fiscal year 2026*
The O-1 has a high approval rate. Manifest Law’s analysis of the latest USCIS data appears to show that roughly 91.2% of O-1 petitions were approved through the second quarter of fiscal year 2026. This covers the O-1 category as a whole, rather than splitting the figure between the O-1A and O-1B tracks.
A high approval rate does not mean approval is automatic. These cases are still reviewed closely, and the outcome depends on the strength of your evidence and how well your file is built.
The O-1B visa is awarded based on accomplishments, not luck
Known as the visa for individuals with extraordinary ability in the arts, or extraordinary achievement in film and television, the O-1B is ideal for accomplished artists, actors, dancers, musicians, designers, producers, and other creative professionals.
Instead of a lottery, it’s granted on evidence: proof that you’re among the best at what you do. It’s initially valid for up to three years, renewable for 1 to 3 year increments with no limit, and can become a stepping stone toward an EB-1A green card down the line, which has a higher bar but similar requirements.
The O-1B requires a U.S. employer or agent to petition on your behalf, and a U.S. agent can represent multiple employers or projects at once.
You don’t need to be famous to qualify!
The real question isn’t “Am I extraordinary enough?” It’s “Which of the things I’ve already done give me the leverage to take control?”
Qualifying is more achievable than you may think
There are two main paths to prove O-1B eligibility. One is to have received or been nominated for a major, internationally recognized award, like an Oscar, Grammy, or Emmy. If you don’t have a major award, you can also qualify by meeting at least three of the following six criteria.
You may already have several of these categories covered, in which case the main thing you need is to explain your accomplishments to USCIS in a way that makes it difficult for them to deny your application.
1
Lead or starring role in productions or events with distinguished reputations, evidenced by critical reviews, advertisements, publicity, or contracts
2
National or international recognition for your achievements, shown through critical reviews or published material in major newspapers, trade journals, or magazines
3
Lead, starring, or critical role for organizations with distinguished reputations, evidenced by articles, publications, or testimonials about your role
4
A record of major commercial or critically acclaimed successes, shown by ratings, box office receipts, or achievements reported in trade publications
5
Significant recognition from organizations, critics, government agencies, or recognized experts, with testimonials indicating the author’s authority
6
A high salary or substantial remuneration compared to others in your field, shown through contracts and other reliable documentation
Nearly every O-1 petition requires an advisory opinion, a written consultation from a peer group or a person with expertise in your field. In rare cases, if no appropriate peer group exists, this requirement can be waived.

Ben needed to move across the Atlantic. Manifest built his O-1 petition against the clock.

“I handed them a lot of information…they were able to take all of that, understand it, and output a thousand page document in the space and time that they did. I honestly have no idea how they did. I can’t say anything but immense praise and gratitude.”

The exact steps for getting your O-1B
The O-1B process follows a clear path, though the timeline depends on how much evidence you already have. Here are the typical steps.
01
Manifest Quiz & Attorney Consult
1–3 days
Start with our free quiz. We’ll assess your eligibility and, if you’re eligible, book your free consultation.
During the consult, you can share your story, get personalized guidance on your case, and make sure it’s the right fit before you commit.
02
Evidence Collection
3–6 weeks
You’ll get a personalized document checklist and access to our secure client portal. With guidance from your attorney and an evidence coach* if needed, you’ll upload materials that showcase your achievements and impact. See your case progress live, watch what your lawyer is working on, and message your lawyer directly through the portal.
03
Petition Drafting, Review & Filing
4–6 weeks · varies by case
Your O-1 visa attorney drafts the full petition, including letters, a personal statement, and a cover memo. Depending on the plan you choose, your case is then reviewed by a second attorney or former USCIS officer to ensure it’s strategically sound.
04
Petition Decision
15 business days (premium) · 2 months+ (standard)
After final review, we file your case with USCIS. Processing times are dependent on USCIS, but premium processing can guarantee a decision within 15 business days.
*Disclaimer: Working with an evidence development coach does not guarantee approval of your case.
The O-1B visa can earn you freedom, flexibility, and prepare you for Extraordinary Ability Green Card applications. Getting the details and presentation right is how you can improve your approval odds.

The team was simply fantastic. Initially, I thought my case was not highly strong. What impressed me most was their legal expertise extracting the most valuable insights from facts to support my case. Communications with them were effective and pleasant. I greatly appreciated the team’s understanding and quick action. I would highly recommend them.
